Following a discussion on the flexibility clause as it applied to the distribution of funds under an NPP to enterprises established after the cut-off date of July 1995, the Executive Committee decided:
- To take note of the desk study on the evaluation of management and monitoring of national phase-out plans contained in document UNEP/OzL.Pro/ExCom/51/13, including the proposed evaluation issues and work plan for the second phase of the evaluation;
- To request implementing agencies to seek authorization from the Executive Committee prior to using the flexibility provided for under multi-year agreements (MYAs) to allow funds to be directed to enterprises established after July 1995 in cases where countries had committed to the total phase-out of the ODS concerned; and
- To request the bilateral and implementing agencies to report, as part of their regular periodic reporting under MYAs, whether they had used the flexibility clause for this purpose.
