Decision 80/58

Following discussions in an informal contact group to clarify the issues, the Executive Committee decided:

1. To approve, in principle, stage II of the HCFC phase-out management plan (HPMP) for Kenya for the period 2017 to 2030 for the complete phase-out of HCFC consumption, in the amount of US $1,763,850, plus agency support costs of US $204,023 for the Government of France, on the understanding that no additional funding would be provided to the Government of Kenya for the phase-out of HCFCs;
2. To note the commitment of the Government of Kenya:
   1. To reduce remaining HCFC consumption by 1 January 2030;
   2. To issue a ban on the import of HCFC-based equipment and HCFCs other than HCFC-22 by 31 December 2020;
3. Further to note:
   1. That Kenya had consumption in the servicing sector only;
   2. the financial incentive scheme would enhance the sustainability of the training of servicing technicians and would be co-financed by participating end-users;
4. To deduct 21.78 ODP tonnes of HCFCs from the remaining HCFC consumption eligible for funding;
5. To approve the Agreement between the Government of Kenya and the Executive Committee for the reduction in consumption of HCFCs, in accordance with stage II of the HPMP, contained in Annex XVI to the present report;
6. To approve the first tranche of stage II of the HPMP for Kenya, and the corresponding tranche implementation plans, in the amount of US $456,500, plus agency support costs of US $52,803 for the Government of France, on the understanding that if Kenya were to decide to proceed with retrofits and associated servicing to flammable and toxic refrigerants in refrigeration and air-conditioning equipment originally designed for non-flammable substances, it would do so assuming all associated responsibilities and risks and only in accordance with the relevant standards and protocols;
7. To request the Government of Kenya to submit a letter through the Director, Multilateral Environmental Agreements, no later than 31 December 2017, confirming its commitment to accelerate, full phase-out of HCFCs by 1 January 2030;
8. To request the Government of France when submitting the second tranche:
   1. To review with the Government of Kenya the implementation plan and strategy of stage II of the HPMP, with a view to considering activities other than those currently included, in order to optimize the effectiveness of the HPMP;
   2. To report on the status of implementation of the ban mentioned in sub‑paragraph (b)(ii); and
9. To request the Government of France to report on the project management unit expenditures in the tranche progress report along with the measures taken to keep the expenditures below the approved levels.
